'Pemberton verdict could lead to more abuse vs LGBTs'

MANILA – LGBT (lesbians, gay, bisexuals, transgender) rights advocates are criticizing the Olongapo City Regional Trial Court for coming out with the verdict on the Jennifer Laude slay case that opens the already vulnerable sector to more abuse.

US Marine Lance Corporal Joseph Scott Pemberton was found guilty of homicide and was sentenced by Olongapo City RTC Branch 74 Judge Roline Jinez-Jabalde to 6 to 12 years imprisonment.

Pemberton was originally charged with murder before the court, but this was downgraded to homicide due to the absence of any aggravating circumstance.

The court said it cannot appreciate the attendant circumstance of treachery, which is a ground for murder. The two other attendant circumstances for murder – abuse of superior strength and cruelty – were also not proven by the prosecution, the court added.

The court likewise cited two mitigating circumstances in the Laude slay.

Under the Indeterminate Sentence Law, if there are two or more mitigating circumstance and no aggravating circumstance, penalty lower in degree shall be the one imposed.

One of the mitigating circumstances counted in favor of Pemberton was the so-called ''passion and obfuscation."

The court ruled that Pemberton was the ''more plausible suspect'' ''because he was the only person who has the motive to kill Laude'' after ''he was deceived by Laude into believing that he was a woman, when in fact he was a man when he offered him sex for pay."

''Pemberton could have been so excited and sexually aroused and started reaching for Laude's vagina, hoping to consummate the sexual act and satisfy his sexual desire. When he felt something weird which should not have been there, he realized what was on top of him was a man,'' the court said.

''He was so disgusted and repulsed with what he discovered. He found the situation so revolting and despicable. This overcame his reason and self-control."

CHILLING EFFECT

For Bemz Benedito, chair of pro-LGBT rights group Ladlad, this decision has created a chilling effect for members of the LGBT community.

''I warned my fellow transgender sisters and brothers that this decision of the court also sets a dangerous implication and precedent to have mitigating circumstance due to the discovery of one's sexual partner's gender identity and expression. This makes us all more vulnerable and easy targets of hate crimes and bigotry related violence,'' Benedito said.

Jacob Walse-Dominguez, a San Francisco-based Filipino who actively participates in discussions of LGBT issues, said the RTC decision puts members of the LGBT community in a vulnerable position.

''My problem with this sexist and transphobic crediting is that it also creates jurisprudence for hate crimes in this country. The PH has no hate crime law yet, and if any person commits a hate crime against LGBTQs, we are essentially saying it is okay, that you can plead for a lower sentence just like Laude vs. Pemberton,'' Dominguez told ABS-CBNnews.com.

''This decision is saying that being transgender is deserving of being murdered especially since one has 'fooled' a man into sex with her.''

Dominguez argued that studies have shown that transgender folk's gender identity does not match their biologically assigned gender. Thus, he said it is possible that Jennifer had no intention to deceive Pemberton because she viewed herself as a real woman.

''This is prejudice moving within our own justice system. We cannot count on our country's laws to protect us or hold our honor,'' he said.

''Jennifer took on the gender expression of a woman because that is her gender identity. If she was still alive and we ask her 'if your physical genitalia was not considered to be inherently male or female, what do you identify as?' She would definitely say female. Laude lived as a female and acted as female because in her eyes she was one, and tried to live it out to the fullest extent this society would let her.''

Laude family lawyer Harry Roque agreed, saying the court ruling sends a wrong message to the public.

"It sends a message to the public that it's okay to commit hate crimes against LGBTs because if you suffer from a mistaken belief that a woman is in fact a man and you kill him, you'll be entitled to lesser penalty. That to me is so bad, so objectionable," Roque told ANC's Headstart.

Roque said they are studying their options to avert the possible damaging effects that could result from this ruling.

NO TREACHERY, ABUSE, CRUELTY

In her decision, Judge Ginez-Jabalde said the attendant circumstances of treachery, abuse of superior strength and cruelty were not satisfied by the prosecution.

The court said the prosecution failed to adequately describe to the court how Pemberton made use of his strength in killing Laude.

''Abuse of superior strength is not present when killing was unplanned and not premeditated, the event was not planned and not deliberated. Pemberton did not know Laude in the first place,'' the court said.

Roque said this does not make sense. ''What do they call that killing if not cruel?" he asked.

''He's a trained Marine as against a transgender, for crying out loud! I don't see why the judge did not see the [abuse] of superior strength,'' he added.

Roque added that treachery was definitely present when Pemberton choked Laude with the latter's face slumped in the toilet bowl.

The verdict handed down on Pemberton was bittersweet for the Laude family, who was glad that the US Marine was found guilty but worried that US intervention might snatch justice away from their hands.

Court: Laude died of asphyxia by drowning

MANILA - The Olongapo regional trial court handling the murder case of Jennifer Laude ruled that the victim died of drowning.

The Olongapo City Regional Trial Court Branch 74 gave credence to the findings of prosecution witness PNP Crime Laboratory - Region 3 head Dr. Reynaldo Dave who earlier said there were traumatic injuries on the neck of Jennifer, which could mean strangulation; as well as fluid oozing from her lungs, which could mean there was drowning.

"This court gives more credence to prosecution witness Dr. Dave's testimony as it is more consistent with the injuries sustained by the deceased," the clerk of court said, reading the court's decision.

The court will soon release its verdict on the primary respondent in the case, US Marine Lance Corporal Joseph Scott Pemberton.

During the promulgation, the court also dismissed Pemberton's excuse that he tried to revive Laude.

"The accused's intent to drown the deceased was even made more manifest when he brought Laude to the side of the toilet where he can easily and conveniently access the flush lever as he maintains the deceased head inside the toilet bowl," the court said.

"This court considers the crime scene autographs and finds the body's position relevant to the toilet's flush lever more logical since the accused had more ease to access the flush lever, enabling him to simultaneously press the lever - releasing the water down the toilet bowl - and maintain the victim's head also down the boil."

"Had the accused's intention is to revive the victim, the body should have been recovered slumped to the bathroom floor beneath the shower head and faucet, his head not inside the toilet bowl."

Laude's body was discovered inside the bathroom of Celzone Hotel in Barangay West Tapinac, Olongapo City in October last year.

Hotel staff found the lifeless Laude wrapped in a bed sheet, with her head slumped in the toilet bowl.

Police said Laude checked in at the hotel with a foreigner, who appeared to be in his mid-20s. The foreigner then left the room after about half an hour.

Initial investigation revealed Laude's neck was pressed down on the toilet seat, while her head was being shoved into the toilet bowl.

Police then tagged a US Marine as the person who accompanied Laude in the motel. This US personnel would later be identified as Pemberton.

What US experts discovered in Laude slay

MANILA - Three US experts on Monday testified in the trial of US Lance Corporal Joseph Scott Pemberton, who is accused of killing Filipino transgender Jennifer Laude.

Jessica LeCroy, latent print examiner of the US Army Criminal Investigation Laboratory (USACIL), told the Olongapo City trial court that a "suitable latent fingerprint " of Pemberton was found in the condom wrapper recovered in the bathroom where Laude was found dead.

Derek Dorrien, a forensic lubricant expert also of the USACIL, testified that the lubricant found in the condom wrapper is the same lubricant found in the penis and body of Pemberton.

He said the same lubricant was also found in Laude's anus.

Dr. George Jackson, a toxicologist of the US Armed Forces Medical Examiner System (AFMES), meanwhile said Laude's blood tested negative for either toxins or illegal drugs.

His testimony debunked earlier allegations that Laude was a drug-user.

Laude camp to appeal Pemberton custody, ask permission for media coverage

MANILA - The Laude camp is ready to bring the custody issue over US Marine Joseph Scott Pemberton, the suspect in the killing of Jennifer Laude, before the Supreme Court (SC).

The US has insisted on taking custody of Pemberton under the Visiting Forces Agreement (VFA).

Atty. Virgie Suarez, one of the counsels for the Laude family, said they will also bring to the high court their appeal for permission for media coverage of the trial which has been denied by the Olongapo Regional Trial Court.

She noted it can be an argument against the VFA.

"We will elevate this matter before the Supreme Court, and also the custody issue we will elevate the matter before the Supreme Court. We, Harry [Roque] and I, believe that makes the whole VFA unconstitutional because in the way it is being implemented now," she told ANC's "Headstart" Tuesday.




Suarez, meanwhile, noted plans by Pemberton's camp to ask the Court of Appeals (CA) to downgrade his case from murder to homicide will no longer delay the case.

While the Pemberton camp can still invoke their right to plea bargaining, she insisted amicable settlement is not an option for the Laude family.

"Plea bargaining can only happen with the consent of the family. That's why yesterday the family was already saying there can never be compromise agreement, there can never be settlement. Plea bargaining can't happen without the consent of the Laude family."

Suarez is hoping the court will rule on the Laude case within the one-year deadline.

Regardless whether there is any witness, she insisted they have the evidence to prove murder.

"We do believe we have a strong case. There are many evidence," the lawyer said. "Most of the rape cases, most of the killings do not really happen in the presence of so many people. That can be seen from the forensic, from the evidence."

"For example in this case, who can possibly kill Jennifer except Pemberton? He was the only one who went in and was the only one who got out, and we have a witness who can prove...who was sitting out the door the whole time," she added. -- ANC

Laude's sis: I wanted to shove Pemberton

MANILA - "Why did you kill Jennifer?"

The sister of slain Filipino transgender Jennifer Laude confirmed seeing US Marine Joseph Scott Pemberton inside an Olongapo regional trial court on Friday.

Marilou Laude said seeing Pemberton, the suspect in the murder of Jennifer, in court brought mixed emotions.

"Mixed emotions. Natatakot, nagagalit. Kung puede lapitan ko siya, tanungin, kung pwede iuntog ko siya sa pader pero napakaraming gwardiya. NCIS na naka-buddy sa kanya."

(I was afraid, angry. If only I could go near him, ask him. If only I could shove his head to a wall but there were so many guards, members of the Naval Criminal Investigative Service.)

She said she was able to take a picture of Pemberton inside the court.

Marilou said Pemberton looked at her and then looked away.

If given a chance, she said she wanted to ask Pemberton why he killed Jennifer.

"Ang gusto ko itanong sa kanya paano niya napatay ang kapatid ko e yung mukha niya napakainosente? Paano nya nagawang patayin ng ganun kabilis yung kapatid ko na walang reason?"

Pemberton is facing a murder case for the killing of Filipino transgender Jennifer Laude in Olongapo City last October 11.

He is currently detained at the Mutual Defense Board – Security Engagement Board (MDB-SEB) facility in Camp Aguinaldo.

On Friday, Pemberton was brought to the court for his fingerprints and mugshots. He also underwent a medical exam.

He was then brought back to the MDB-SEB facility.

Atty. Virgie Suarez, a lawyer of the Laude family, said Pemberton submitted himself to the jurisdiction of the court and was booked.

Atty. Harry Roque, another lawyer of the Laudes, said he will file a motion to have Pemberton transferred to a regular jail. He insisted that only the court can decide on the issue of custody for Pemberton.

PH seeks custody of US Marine charged with murder

The Philippine government sought formal custody Tuesday of a US Marine charged with murder over the death of a Filipino transgender woman after a court ordered his arrest.

In a case that has fanned anti-American feelings and tested close military ties, Joseph Pemberton was charged Monday with murdering a transgender woman who was found dead at a cheap hotel in the northern port city of Olongapo in October.

A lower court in Olongapo ordered the defendant's arrest Tuesday and ruled he will not be entitled to post bail, court officials said.

"We welcome the progress made so far on the case, and as we stated earlier, we will now formally seek custody over the accused," foreign department spokesman Charles Jose said in a statement.

Pemberton has remained under official US custody even after he was transferred from a US warship off Olongapo to the Philippine military headquarters in Manila amid a public outcry.

Jennifer Laude, a 26-year-old transgender woman also known as Jeffrey, was found dead on October 12 in a cheap hotel in a red light district of the port city of Olongapo.

Pemberton, 19 at the time, had just finished taking part in US-Philippine military exercises near Olongapo and checked into the hotel with Laude. He was the last person seen with her, police said.

Murder is punishable by up to 40 years in jail.

The US embassy issued a statement Tuesday on the murder charge against Pemberton, but made no mention of the court order for his arrest.

"In accordance with the US-Philippine Visiting Forces Agreement, the United States has a right to retain custody of a suspect from the commission of the alleged offence until the completion of all judicial proceedings," it said.

"The United States will continue to work closely with the Philippine government to help ensure justice is served and the rights of all persons are protected."

A US embassy spokeswoman did not immediately reply to requests for comment by AFP on the arrest order and the foreign department's request to seek custody of Pemberton.

Laude's death sparked street protests in the Philippines, a former US colony that gained independence in 1946 but has retained a close alliance.

The United States closed down two major military bases in 1992, but the allies in 1998 signed a Visiting Forces Agreement that allowed US troops to take part in war games on Philippine soil.

Military exercises involving thousands of US soldiers have since taken place each year.

Pemberton has low morale, being guarded vs suicide

MANILA - US Marine Joseph Scott Pemberton, suspect in the murder of Filipino transgender Jennifer Laude, is in very low spirits more than two months after the incident, an Armed Forces spokesman said Tuesday.

"Siyempre, bata pa yan. Siguro pagkatapos niyang ma-realize kung ano yung ginawa niya, nalungkot siya talaga," AFP spokesman Col. Restituto Padilla said.

Padilla said Pemberton is being closely monitored to prevent the possibility of him wanting to hurt himself, or worse.

AFP Chief of Staff Gen. Gregorio Catapang Jr. earlier said that a fellow US Marine was detailed with him inside his detention cell, to prevent him from committing suicide.

A source said it gravely affected Pemberton emotionally when he realized that his actions had tarnished the name of his unit and the rest of the US Marine Corps. This, apart from realizing the gravity of the case that he now has to face.

The Philippine military also declined to say whether there were any preparations being done for the possible transfer of Pemberton to a different detention cell, saying all decisions will emanate from the Visiting Forces Commission, as agreed upon by both the governments of the Philippines and the United States.

Pemberton was reportedly on furlough after participating in a naval drill between Filipino and US forces in Zambales, when he allegedly killed 26-year-old Laude in Room 1 of Celzone Lodge on Magsaysay Boulevard, Olongapo City.

The charge sheet against Pemberton released on Monday detailed what the prosecutors said was an unprovoked and relentless attack against a defenseless victim.

"Respondent Pemberton choked Jennifer from behind. Obviously, in that position, Jennifer was deprived of the opportunity to defend herself," the six-member prosecutors panel said in the charge sheet.

"Undeniably, respondent (Pemberton) made sure that Jennifer was dead. He did not stop at badly beating her up and choking her, he made sure she suffered to her death.

After Laude rally, tighter security for Pemberton

Media barred from filming Pemberton quarters

MANILA - Even from across the street, journalists are no longer allowed to take footage of the United States-controlled JUSMAG facility inside Camp Aguinaldo, where US Marine Joseph Scott Pemberton is said to be detained.

The facility is now named the Mutual Defense Board (MDB) and Security Engagement Board (SEB) facility, for use of American military personnel while talks are ongoing among the Mutual Defense Board members.

Pemberton was flown into the facility by a US helicopter from the vessel USS Peleliu in Subic Bay.

He is now guarded by fellow US Marines, and his detention there means that custody remains with the United States.

Journalists were filming outside the perimeter fence on Wednesday when Pemberton arrived, but were not allowed to film up close.

Now, Filipino United Nations peacekeepers who had just arrived from the Golan Heights are manning the perimeter, preventing the press from taking any more footage.

The gap between container vans has also been covered with a shelf by US Marines, to further prevent the media from getting a view of Pemberton's detention area.

New restrictions on the movement of the media are now also enforced inside Camp Aguinaldo.

They are told that they can only stay at the grandstand. Driver's licenses are now surrendered at the gate, and the media will be forced to leave camp premises by 5 pm.

This is the AFP's response to Wednesday's commotion, when the media covered the family and fiance of slain transgender woman Jennifer Laude as they stormed past the outer gates of the MDB-SEB facility to try and talk to Pemberton.

The Laudes have been prevented from having an audience with Pemberton since the killing took place.

Atty. Harry Roque, counsel to the Laudes, said they were also prevented from taking saliva and urine samples from Pemberton, which would be instrumental to the murder case.

General Arthur Ang berated the media for following the Laudes into the outer gate, saying everyone was in violation of camp rules.

A truckload of civil disturbance management officers with shields were then deployed to herd the media away and stop all reports in the area.

Lt. Col. Harold Cabunoc also arrived at the scene, and scolded Jennifer's sister, Marilou Laude, who had crossed the fence.

Cabunoc told the Laudes - who by that time had been asking to speak to any military officer - that they were trespassing and could be jailed.

On Thursday, the AFP announced that it would file a complaint against Jennifer Laude's German fiance Marc Sueselbeck, a foreigner who entered a military camp without permission.

Aside from that, Sueselbeck also shoved aside a Philippine soldier in his attempt to approach Pemberton's room just meters away.

The complaint will be filed before the German Embassy and the Bureau of Immigration.

Miriam slams VIP treatment of Pemberton

MANILA - Government officials said the transfer of Private First Class Joseph Scott Pemberton to Camp Aguinaldo was mutually agreed upon by both authorities from the Philippines and the United States.

During the hearing at the Senate, Presidential Commission on the Visiting Forces Agreement (VFA) executive director Eduardo Oban said the decision "was in consultation of both the US and the Philippines, as represented by the Department of Foreign Affairs and the Department of National Defense."

Oban said he was the one who accompanied Pemberton aboard the UH-1Y helicopter owned by the US from the soldier's detention at the USS Peleliu to Camp Aguinaldo on Wednesday morning.

"We took off around 8:00 a.m. together with the legal officer of the US Navy and security personnel from the US," he said.

This, amid Foreign Affairs Secretary Albert del Rosario’s acknowledgement that custody over Pemberton "can be claimed by the US."

Assistant Foreign Affairs Secretary Eduardo de Vega of the DFA Office of Legal Affairs said: "We have always been telling them, there is no way we will allow him to be detained in the US embassy. We even invoked [Senator Miriam Defensor Santiago’s position]… it must be in sovereign Philippine territory."

Santiago agreed, and said: "I would rather die."

Oban said Pemberton will stay there until a charge is filed in court and custody is transferred to Philippine authorities.

Santiago, who presided over the hearing, asked: "Who will furnish his meals there?"

Oban answered: "The US government.”

Oban said there is also US personnel guarding Pemberton in his detention.

Asked if he can accept visits, Oban said, "Such arrangements can be discussed [by the parties]."

Senator Sonny Angara asked Del Rosario what would happen if the same scenario happens to a Filipino soldier in the US.

Del Rosario said: "The US will have custody... because of the nature of the activities entered into."

In a press release issued after, Santiago slammed the VIP treatment of Pemberton.

She said the US has "engineered a sham Philippine custody over Pemberton.”

“He arrived by helicopter, protected from accusing eyes. He is detained in an air-conditioned facility. Outside his door are American guards. Outside the facility are Philippine soldiers. The mere physical arrangement indicates that he is being guarded against his Filipino critics,” she said.

She even described the arrangement "offensive," because it shows VIP treatment accorded to Pemberton supposedly owing to the US desire to quell howls for Philippine custody over the marine.

Earlier in the hearing, Santiago insisted that the Philippines should take immediate custody of the suspect upon commission of the crime since it happened in Philippine soil.

She had also called for the scrapping of the VFA, saying it was heavily tilted towards the US.

During the hearing, Santiago also wondered if there were guidelines drafted on the matter of custody.

She said the VFA has "iniquitous" language.

(Editor's note: Marc Suselbeck, the German boyfriend of transgender Filipino Jennifer Laude, has issued the following statement in reaction to the murder of his girlfriend. It has been lightly edited for clarity, with a portion redacted because it could be considered libelous.)

To whom it may concern:

I want to take words in that case, as I am the "fiance" of Jennifer since two years (as mentioned in your reports), which is not the full truth, as we were engaged since December 2012 officially and with full knowledge and acceptance of her family.

Our plan was always to marry and to start life over together. We started a first try in March 2013 to bring her here for visit and for making the marriage legal too, but it was denied from German embassy at that point, for claiming the same discrimination and prejudices which now most likely caused her death.

Her visa that time was denied for the reason that there was (disbelief) "in her rootedness in the Philippines."

So basically, (because) the embassy suspected her to have illegal and criminal acts in mind, not obeying visa regulations and trying to stay illegal in Europe, also the simple reason in her gender and her being not from a rich family.

That first time gave me the glimpse on the ongoing discrimination in the Philippines on many kind of groups.

Is it based on gender or on the richness? People like Jennifer will never get a fair chance in your country, and she is just one of thousands, maybe millions in your country sharing the same destiny of your countrymen.

We were very positive for another visa application as I was already discussing that issue with German embassy and the appointment for the visa form was set to 16th October. But now it never will happen.

I stand here with my clear name, with my personality, with my job information even to make clear, what your society is doing to persons like Jennifer.


I  know her well. We have talked thousands of hours. Since December 2012, I spent nearly 90 days with her in the Philippines. Jennifer (has) been the most true, hopeful, and life-hungry person I ever met in all my life.

She had her childish moments. She was hot tempered. And her feelings (if low or high) were always extreme. But she was authentic.

She was herself, and remained it. Even if her country never supported her in growing and develop as it is the major task for any society and politics, to grant that for their citizens.

She was so much looking for justice. More than once she did risk her own health in standing up for others. She did save her sister's life after she had a bad accident. She was even giving up all her own goods to support her family, and her sister's therapy, her brother's studies.

She was never selfish, and even if she looked and appeared like a beauty queen, she never behaved like that. In simple words she have been the most natural and pure and down to earth person I ever met.

To make it clear: this horrible act has two reasons.

The animalistic bestiality of an obvious sick and retarded bloodthirsty American soldier who has no respect at all from human life as also especially not from Philippine people, but as well in your own society and corrupt politics.

Look at a city like Olongapo. Where is the so well-known hospitality there? Only you will find it in the normal poor people. I have been there (for a long time) so I can say.

But what is the government and the mass of the society? Corrupt to the bone. All you can get (is) in Olongapo and other capitals. All for money. You can get away even with any criminal act if you are a foreigner. It just costs money.

No wonder the monster soldier did think he would get away with it. You show him that every day. Your society does. How should a foreigner respect people like Jennifer if your own society doesn't?

So face your own guilt. And if the death of Jennifer is for one sense. Learn from it. Listen to the gender protests of those who now finally stand up. Open your eyes (to) what is happening around you and make everyone part of your community.

Isn't one slogan: STAND TOGETHER OLONGAPO? Why don't you start with those who you do let stand outside from your society?

Aim high Olongapo? What a joke, regarding what (life) you offer to the majority of your own people.

I will try my best to get there as soon as I can, to pay the honor and respect to Jennifer as the Rose of Olongapo, the honor and respect she simply (deserves) for lifetime but never got from society.

And I will stand with my name for what did happen to her. That was what probably gave her hope to keep on fighting with me hand in hand every day for a better life even when her own country s*** on her. I (stood) with her no matter what, never hid in public or nowhere. And even more now, I will speak for her with my name, with my person. I won't (hide) from anyone or prejudices or discrimination.

I am proud of being engaged to Jennifer -- with probably one lost jewel in your country.

I will also stand with the hopefully rising protest against that ongoing discrimination. You can mention my name everywhere. You can also contact me. I will be open for any interview or anything. I owe her that respect her country never gave her. I stand with her now, in the past, in the future. And the whole world can know that.

One last thing, as I did talk to Jennifer just 2 hours before her death and I definitely know her well. If you can be sure about one thing, she was sure not stealing. That was never her attitude.

And if you use your brain, if you keep in mind the brutality and inhumanity of her murderer, the way he did it. That's not stopping a thief.

Could you maybe try to think if Jennifer was pure and only victim from the first moment on? Maybe even already the moment they did went into the room? You can probably ask all Olongapo.

Jennifer wasn't a prostitute. Maybe she did offer that guy kind of service, but maybe not enough for him? You ever thought that? Wouldn't that fit much better to the way he murdered her? As an animal who cant accept a "No"? From such an unworthy person like a ladyboy even?
