Binay major loser in presidential debate: analysts


Vice President Jejomar Binay appears to be the biggest loser in the second round of the Commission on Elections (Comelec) debate, analysts claim Monday.

This, after Binay, who had been misinformed by sponsor network TV 5 about being allowed to bring notes to the debate, caused a one-hour delay in the televised program.

Julio Teehankee of De La Salle University College of Liberal Arts (DLSU CLA) said Binay emerged as this round's major loser after the delay controversy “shattered his narrative that he is the most experienced among all of them.”

Teehankee, who likened the exchange to a “political reality TV" said the debate also “shattered [Binay's] narrative that he is the most experienced among all of them.”


During the debate proper, Binay failed to deflect accusations thrown at him by rivals, said Edna Co of the University of the Philippines National College of Public Administration and Governance (UP NCPAG).

Co observed that Binay once again argued on the legality of these allegations, banking on the fact that no material cases have been filed against him.

“In the end, by people’s perception, the way that he defended himself, or not quite effectively defended himself, is that people still hang on to the idea that there is a reason for suspicion,” she said, adding that the whole spirit of debate is handling the issues and rising above it—hence the losing mark.

Both analysts agree that this will adversely affect Binay's survey ratings.

WHO WON DEBATE? 

Teehankee noted that among the four candidates, Poe was the only one who was an actual debater. Although she lost her cool when she was hit with the issue of citizenship, Teehankee urged people to “cut her some slack” as she had been enduring this allegation for quite some time now.

Co meanwhile described Poe as a “modern Filipino Gabriela,” both with her decorum and debate performance.

“She showed how vigorously she was arguing, she’s showing the character of a strong, modern Filipina, putting up the issues, and confronting three male competitors,” she said on Mornings @ ANC.

Her inexperience, Teenhangkee and Co said, could well be interpreted as a weakness and strength. On one hand, she is a candidate, who like Duterte, is an outsider—not from the administration, not from the opposition—and she has been doing well in the surveys because of this. On the other hand, her answer to Duterte’s question on the coast guards also reflected her lack of political understanding and bureaucracy.

“That reveals a weakness on her part in terms of her broad policy understanding, especially foreign policy and national security. My first response would have been I will convene, I will call for the National Security Council and ask for an immediate briefing on the matter. And then the second would be to contact our key allies, and third would even be to invoke the mutual defense treaty,” Teehankee said.


For Co, meanwhile, Roxas was the sole the winner this round, considering the degree of allegations thrown at him and the defense was able to carry. She noted that he was not only defending his credentials but also the shortcomings of the current administration.

“In last night’s debate, Secretary Mar succeeded in putting the blocks together—which means he was able to see and make the public understand there were failures of the administration but there are successes; there are criticisms against the administration, but he also tried to be the good knight, the good person of the administration by being an insider so he was able to figures and the facts. And I think sounded very convincing,” she said.

Teehankee noted that Roxas' usual weakness was his failure to connect emotionally. He however lauded Roxas' ability to “concretize his vision of decency, rule of law, a rule-based society, a society where there’s equality in terms of government, of government service.”

DUTERTE'S GAIN

Duterte’s significant improvement in this debate, according to the professors, was his effort to soften his image.

Teehankee likened him to a choir boy who was both behave and naughty, and was “pilyo” and “alaskador.” He fired many controversial issues to the other candidates, but his efforts to be charming were more evident in the outtakes where he was seen mixing well with the other candidates, but Teehankee pointed out that his mention of violence could always turn off the independent voters he’s been trying to lure.

“Because his core supporters are essentially attracted to him because of this tough guy, anti-crime macho image, but is not getting any traction beyond Mindanao, beyond his core demographics, he need to attract the independent voter, those who are not convinced that he will be a good president. But I don’t think, despite the fact that he was behave last night, the very fact that he mentioned killing again—‘you cannot be president unless you are willing to die or to kill’—again brings out the red flags in the mind of the independent voters," Teehankee said.

Binay camp says Goldilocks cakes smaller, blasts deception


MANILA - The camp of Vice-President Jejomar Binay believes there was deception and possible collusion in the bidding of cakes for Makati senior citizens on Monday.

Joey Salgado, spokesperson of Vice-President Binay, said the premise for the bidding is wrong since the cakes purchased from Bakerite under suspended Makati Mayor Junjun Binay were not overpriced.

He pointed out that lawyer Renato Bondal admitted before the Senate Blue Ribbon subcommittee that he only made a guess that the Makati cakes were priced at P1,000 each when documents later showed that the price of the cakes was only P306 each.

Salgado also insinuated there may have been collusion between acting Mayor Kid Pena and Goldilocks, the lone bidder who showed up on Monday. He said Makati already had a formal bidding but the notice of award has not yet been issued to Bakerite.

"This is on record, last month [Vice-Mayor Pena] said ang magsu-supply Goldilocks na and he even quoted the price between P260 to P285. Ngayon kahapon ano ang lumabas? Goldilocks was the lone bidder and the price that Goldilocks quoted was along that same price range, from P260 to P285. That raises for us a lot of questions. You express preference for this supplier and the supplier is the lone bidder," he said.

He also said the cakes of Goldilocks are smaller than Bakerite's, hence the lower cost. He said Bakerite is a reputable bakeshop with headquarters in Quiapo, Manila.

"These are smaller cakes. Obviously if you ask for smaller cakes, the quotation and bid would be smaller. That's clearly a case of deception. Linoloko na naman nila ang media," he said.

Pena earlier told ANC that he would rather have popular bakeshops such as Goldilocks and Red Ribbon to supply birthday cakes to Makati's senior citizens to avoid controversy over the costs.

"Hangga’t maaari para wala na lang shadow of doubt sa lahat ng mga bagay na ‘yan, gusto ko iba na lang ang gumagawa ng cake. Gusto namin i-try ‘yung Red Ribbon or Goldilocks,” Pena said.

A Court of Appeals order freezing 242 bank accounts and other financial instruments of Vice-President Binay and associates also revealed that the Binays have links to Kim Tun Chong, the sole proprietor of a business that supplied the birthday cakes.

On Monday, Bids and Awards Committee (BAC) Chairman Danilo Villas said the current supplier, Bakerite, was invited to join in the bidding for the cakes contract but did not join.

Gilbert Delos Reyes, new head of the Makati public information office, said the entry of Goldilocks might have caused other interested bidders to back out.

"Dahil Goldilocks iyan, dambuhalang kumpanya, 'yung mga dating nag-signify baka natakot," Delos Reyes said.

Goldilocks' bid was P8,666,080.50. This includes delivery of 31,187 cakes for senior citizens of Makati.

Based on the bid documents of Goldilocks, each cake will cost from P266-P285, depending on the size.

The contract covers cakes to be delivered from August 15 to December 31, 2015.

Why he's leaving: Binay wants to prevent further violence in Makati


"Kahit labag sa aking puso, ako po ay pansamantalang lilisan sa ating City Hall."

A big announcement from Mayor Junjun Binay on the 3rd day of the Makati standoff.

Binay said he's temporarily leaving City Hall as he awaits the Court of Appeals' decision on his petition to stop the Ombudsman's second suspension order against him.

"Kahit na ganito ang dinadanas natin, kahit tayo ay minamaltrato, kahit na binabaluktot ang mga batas, tayo po ay laging magtitiwala sa batas. Wala pa tayong TRO, hindi rin dini-deny ang ating petisyon, pero kailangan natin igalang ang hukuman."

Binay also said he wants to prevent further violence in Makati.

Early morning Tuesday, the mayor's father, Vice-President Jejomar Binay, confronted police officers who prevented people from entering the premises.

The situation took a turn for the worse later in the morning.

Speaking to DZMM, the vice-president blamed police for the violence.

"Sana naman nailabas yung mga panunulak ng mga pulis. Ang napalabas lang sa inyo ay yung reaction dahil sa pinakatulak-tulak ng mga pulis eh kaya napunta sa nagkaharapan po yung mga tao at mga pulis. Alam ba ninyo na pati hipag ko eh tinulak?," VP Binay said.

The Court of Appeals has given the Ombudsman and DILG 10 days to answer Mayor Binay's petition for a TRO. The Binay camp will have five days to reply. Only then will the court act on the petition.

This is in contrast to the CA's action during Binay's first suspension back in March when it granted a TRO even without comments from the Ombudsman and the DILG.

PNoy wants Senate to fast-track Binay probe


BEIJING  - President Benigno Aquino on Tuesday urged the Senate Blue Ribbon Committee to fast-track and complete its investigation on Vice-President Jejomar Binay.

Aquino, who is attending the Asia-Pacific Economic Cooperation (APEC) summit in China, said the investigation should be completed immediately to find out if charges should be filed against anyone.

Asked if he relayed a request to put pressure on the Senate to stop the investigation, Aquino maintained he didn't.

"No. The very first sentence I said was ‘pinakiusapan akong sabihin ito, at least, nasabi ko na sa’yo.’ Hanggang doon na lang… ‘Yung parang tumotoo naman ako doon sa nakiusap ka, sabi mo ito, pinapasabi ito—sinabi ko," he said.

Aquino was asked about Senate President Franklin Drilon's revelation that the President told him to stop the investigation.

Aquino also said Binay, who celebrated his birthday Tuesday, enjoys presumption of innocence.

Aquino however clarified he was only the messenger--relaying the request made by the vice-president.

The said he respected the senate's independence, being a former senator himself.

"The way I phrased it with the Senate President… As you know, ‘nung nagkita kami ni Vice President—medyo some time back, we met in (Bahay) Pangarap—tapos ang… Ang sabi… Was it… But bottom line was ‘pwede bang pakiusapan mo si Frank na pabayaan na ‘yung dapat na processes…’ Nandiyan na lahat e, meaning, the Ombudsman to… In a way, ‘yung hindi… Okay. Ang ginagawa ng Senado is a legislative inquiry—well, an inquiry in aid of legislation," he said.

"‘Yung Ombudsman naman is tasked to ferret out if a crime was committed or not, and if a crime was committed, then to forward the case or to file the case in the Sandiganbayan. Kung nagkakamali ako sa terminology, humihingi ako ng paumanhin sa mga abogado. Pero, ‘yun na nga, so ang sa akin, sabi ko: ‘Frank, pinasasabi ito; sinabi ko lang sa’yo.’ Ang sinabi ko lang naman kay Vice ‘nung binanggit niya sa akin, sabi ko: ‘Nanggaling ako diyan, at saka ‘yung anak mo nandiyan, tanungin mo. ‘Yung Senado 24 kingdoms e, 24 separate kingdoms, so…’ Ang kaya ko lang diyan, kako, basta iparating ko ‘yung pananaw mo; iparating ko ‘yung sinasabi mo, hanggang doon lang," he added.

Aquino said Drilon reminded him that. "‘Alam niyo naman kung paano ang kalakalan dito sa Senado na separate kingdoms nga.’ You’re equals—‘yung, ‘di ba, may phrase: ‘The Senate President is primus inter pares.’ Pero sa Senado, parang ang emphasized ‘yung ‘pares’—equal kayong lahat."

The President said he is neutral in the investigation."I think part of my job here is to be parang neutral eh, ‘di ba? At the end of the day, there will be evidence, one-way or the other, and then to ensure that all of the processes are carried out, ‘di ba? My oath says to defend and uphold the Constitution and other laws. So, at some point in time, nagkakaroon ng formal na complaints and I have to ensure that everybody does what they’re doing or what they are supposed to do. Walang suppression of anything; walang exaggeration of anything. ‘Yung ‘as is’ and ‘where is’. Ano ba ang ebidensya? Does it support the contention or does it not? Then, ‘pag mayroong pinipressure doon sa mga kailangang magtrabaho, e ‘di ibu-buttress ko sila, for them to be able to do their jobs."

Asked why he even acted as messenger, Aquino responded, "Sila ang magdedesisyon eh. Has it gotten to the point that it has matured to go into the more formal processes? Has it… Parang hindi pa ba naabot ‘yung puntong ‘yon? Sila rin ang magde-decide. Nakaabot na ba o hindi nakaabot? Siguro ‘yun ang punto. So, sa akin, tingin nitong nakikiusap naabot na ‘yung punto na dapat, ‘di ba, kung meron man pumunta na doon sa formal. Itong ganito parang… Parang natapos na ‘yung silbi ‘nung inquiry. "

Tiu's companies lose over P1-B in stock market value


MANILA, Philippines - In less than a month after he was accused of being Vice President Jejomar Binay's dummy, businessman Tony Tiu has lost over a billion pesos in the value of his company's stocks.

He has two firms listed at the Philippine Stock Exchange - Greenergy Holdings and AgriNurture.

Greenergy Holdings, owner of Sunchamp Real Estate Development, suffered the biggest loss.

Tiu bared that the hacienda in Rosario, Batangas is a property owned by Sunchamp, contrary to claims of senators who say Binay is the real owner.

October 7 marked the first time Tiu's name was mentioned in the Senate hearings over the alleged overpricing of Makati City Hall Building 2.

On that day, Greenergy was worth P1.981 billion. As of Thursday's close, the company's value is now P954 million.

In just a few weeks, over a billion pesos in value was lost.

AgriNurture, a supplier and exporter of fruits and vegetables, suffered a similar drop. It also runs retail operations, including juice company The Big Chill.

On October 7, AgriNurture was worth P1.616 billion, and now it is only worth P1.4 billion -- a loss of P192 million.

The movement of shares of AgriNurture and Greenergy at the PSE showed they slightly recovered after Tiu's denial of the allegations against him, through disclosures on October 9 and 10, and after his first testimony at the Senate on October 23.

But after that, it was all downhill.

In total, P1.219 billion in value has been lost.

This isn't a blow to Tiu alone. The shareholders of both companies are also affected, including US agribusiness giant Cargill, which owns a 30 percent stake in AgriNurture through Black River Capital.

Cargill's investment in AgriNurture, according to Tiu, is proof positive that he is a legitimate businessman, not a mere dummy to a politician.

But Senators Alan Peter Cayetano and Antonio Trillanes aren't buying it.

They say even Cargill could be an accessory to Binay's efforts to hide alleged ill-gotten wealth.

The controversy isn't lost on regulators. The Securities and Exchange Commission and Philippine Stock Exchange are now watching the Senate hearings closely to check for possible violations by Tiu.

Binay avoids media after talk with bishops


MANILA - Vice-President Jejomar Binay was still elusive to media a day after President Benigno Aquino's statement saying Binay can leave the Cabinet if he feels he's no longer happy to be a part of the Aquino administration.

Aquino has said that Binay is obliged as the government's number 2 man to present solutions to the problems that the country is facing, but never did in any meeting that they have had.

Binay refused to talk about politics Tuesday morning at an event of the Boy Scouts of the Philippines in Marikina.

He told reporters he will give an interview after his scheduled 2 p.m. dialogue with the Catholic Bishops' Conference of the Philippines at Arzobispado de Manila in Intramuros.

Binay arrived at 2:08 p.m. for the meeting. A staff of the vice-president said bishops wanted the meeting to be private, without media coverage.

But the vice-president's staff said Binay will leave the Arzobispado by foot and will grant interview to reporters before boarding his car.

At 4:29pm, Binay's white Land Cruiser slowly moved out from the gate of Arzobispado, with news crews tailing the vehicle.

A couple of meters from the gate, Binay's vehicle stopped, the passenger's door slightly opened but moved again, this time faster towards a waiting security vehicle, before making a turn at the corner and vanishing from the media's eyes.

Binay bought seaside property in Aurora: Mercado


MANILA - Aside from his property in Batangas, Vice President Jejomar Binay also bought seaside property in Dingalan, Aurora when he was still mayor of Makati, his former ally said Friday.

Speaking to Radio DZMM, former Makati vice-mayor Ernesto Mercado said he was instructed by Binay to purchase 7 hectares of land in Barangay Matawi in 1998-1999 after learning that there would be a port there.

He said Binay used to raise chickens there but stopped because the area was not ideal for that type of business.

"Ang manok hindi pwede sa tabi ng dagat," he said.

Mercado earlier told the Senate that Binay used to raise fighting cocks.

Binay also told journalist Raissa Robles in a 2010 interview that he used to raise chickens with breeds coming from Australia and the United States.

In a separate interview with ABS-CBNnews.com, Mercado said he and Binay bought the property for P800,000 per hectare or over P5 million.

"Wala pang titulo nuon, kami pa ang nagpatitulo noon. Nakapangalan sa mga taong naglakad," he said.

"Ang sabi niya: 'Pare, bili tayo para pang retirement.'"

Mercado said the titles for the property remained in his possession until he had a falling-out with the Binays before the 2010 elections.

Mercado ran for mayor of Makati against Binay's son in 2010 and lost.

After the election, he said Binay's daughter, Abigail, asked for the titles of the property in Dingalan.

He said he gave up the four titles to Binay's daughter to see if the vice president would honor his word that they would split ownership of the land.

"Para matesting kung parehas siya ng pakikituring sa akin, pinadala ko lahat ng titulo kahit ang usapan ay hati kami. Pero hindi na ako kumib, wala namang binalik sa akin. Hanggang nayong nasa kanila pa rin yung apat na titulo duon," he said.

He said he also received word that Binay's lawyer, Martin Subido, had visited Dingalan this year in an effort to transfer the titles.

"Hindi kasi nakapangalan sa kanila yung lupa pero sa mga taong nandun sa Dingalan. Hindi nila alam kung paano papipirmahin," he said.

Mercado said he is willing to divulge everything he knows about the Dingalan property if it is raised at the Senate Blue Ribbon sub-committee hearing.

The former vice-mayor earlier accused Binay of pocketing millions of pesos in kickbacks for various infrastructure projects in Makati including the P2.2 billion Makati City Hall Building II.

NO HOSPITALIZATION

In his radio DZMM interview, Mercado again denied the claims of Binay's spokesmen that he was confined at the University of the East Ramon Magsaysay (UERM) Memorial Medical Center on Aurora Boulevard in Quezon City earlier this month.

The former vice-mayor said he has never been confined at the UERM and that he does not have a heart ailment.

"Sa harap nang buong media, payag akong magpa examine para malaman natin kung ako'y may sakit sa puso," he said.

Mercado said he stands by his earlier challenge that he would ask the Senate to strike out his testimony from the record if the Binay camp could show proof that he is lying about his hospitalization.

Binay spokesmen earlier said a certain Ernesto Mercado was confined at UERM last October 1 and October 4 based on medical records they obtained. They also claimed that Interior and Local Government Secretary Mar Roxas visited Mercado on those dates.

Mercado, however, said the Binay camp could simply ask for the CCTV footage at UERM during those dates to show if he was indeed confined there.

"Pag nagsisinungaling, madaling sabihin ang pangalang Ernesto Mercado. Patunayan muna nila na ako yung Ernesto Mercado na sinasabi nila," he said.

The former vice-mayor said he has always gone to Makati Medical Center to get blood work done.

He also said he is willing to be cross-examined by Binay if the vice-president decides to accept the invitation and attend the hearing of the Senate Blue Ribbon mother committee.

"Ako ay nakahandang mag face-to-face kay VP Binay. Hindi ko lang alam kung may question and answer. Payag din akong ma cross-examine sa lahat ng aking sinabi kung kailangan," he said.

Batangas estate still listed under ex-owners' names


MANILA - Danny Alday bought a 10.5928-hectare land in Barangay Bayawang, Rosario, Batangas from his uncle, Benito Alday, around 1993 or 1994.

He said two months after he acquired the land, he sold it to an agent of buyer from Makati City.

He said the agent told him that they wanted to buy the other lots around the parcel of land they already acquired in Rosario.

He said the agent also told him that they wanted to convert the then mahogany-planted area into a farm.

"Ang sabi nila may nabili na sila. Sabi nung ahente ay karatig daw nung kanila kaya interesadong mabili yung aking lupa na nabili ko nga dun sa uncle ko," Alday said.

"Ang sabi sa akin nung ahente, taga-Makati raw ang buyer nila. Yun lang," he added.

Alday said he sold the lot for around P550,000 per hectare. He said he surrendered the original land title and signed the deed of sale.

"Basta titulo nung lupa dala namin yun at kinuha nung ahente... Basta may pinirmahan lamang ako dun," he said.

After the transaction, however, Alday said his uncle still continued to receive demand letters for payments of tax delinquencies until 2010.

Three properties of Antonio Tiu's Sunchamp Real Estate Development Corp. -- girls' quarters, men's quarters, and bodega -- are constructed on the lot still listed under Alday's name.

Meanwhile, Lynette Desphy, whose name also appears on records of the Batangas Assessor's Office as one of the owners of the land where Sunchamp properties are located, likewise denied owning any piece of land in Rosario, Batangas.

She said her father sold their family's lot years before he died in 2006. She also noted that she never paid taxes for any land in Rosario.

"Akin yun? Hindi, wala akong pera. Wala na kaming lupa sa Rosario, Batangas," she said. "Hindi nga akin yun. Kung nakapangalan sakin, hindi ko alam kung bakit."

Sunchamp has 8 properties on her land: a hotel, butterfly farm, grand pavilion, greenhouse building 6, CR, kitchen, commercial building, and garage.

Records of the Rosario Municipal Treasurer's Office show that the taxes of the 1.3 hectare land supposedly owned by Desphy, as well as the properties Alday, Hilario Comia, Maria Guico, Maximillian Desphy, Balbino Perez and Renato Comia Sr. -- who are the recorded owners of the land where properties of Sunchamp are located -- were all paid last June 30, 2014.

The property taxes of Anna Marie and Laureano Gregorio Jr. were also paid on the same date.

Taxes for all the said properties were also all paid last December 23, 2013.

Meanwhile, the tax mapping division of Batangas said properties of Sunchamp are located in a 176.661-hectare area in Barangays Maligaya and Bayawang.

The Assessor's Office, however, said it cannot determine the lot under Tiu, who claimed that he bought a 145-hectare lot from Gregorio.

Records also show that Gregorio and his wife only own a 4.5283-hectare land.

The land property listed under Sunchamp, meanwhile, is just 1.1850 hectares.

Renato Comia Sr. earlier claimed that he is the rightful owner of a 21-hectare lot which he let Agrifortuna and Vice President Jejomar Binay use.

Ten properties of Sunchamp are built there: mansion, office building, guest house and seven greenhouses.
