Pemberton found guilty of homicide


MANILA  – US Marine Lance Corporal Joseph Scott Pemberton on Tuesday was found guilty beyond reasonable doubt of the crime of homicide for the killing of transgender woman Jennifer Laude.

Judge Roline Ginez-Jabalde of the Olongapo City Regional Trial Court's Branch 74 handed down a guilty verdict and sentenced Pemberton to 6 years as minimum to 12 years as maximum imprisonment.

The court also ordered Pemberton to pay Laude's heirs P4.32 million for loss of earning capacity, P155,250 as reimbursement for wake and burial expenses, P50,000 for moral damages, P50,000 as civil indemnity and P30,000 for exemplary damages.

The court noted that the P100 millon in damages being sought by the victim's heirs is ''excessive and outrageous and has no basis at all.''


Pemberton was originally charged with murder before the court, but this was downgraded to homicide due to the absence of any aggravating circumstance. The court said it cannot appreciate the qualifying circumstance of treachery, which is a ground for murder.

The court likewise cited two mitigating circumstances in the Laude slay.

The first is that "passion and obfuscation" as mitigating circumstance were present in the Laude case.

It noted that Pemberton was deceived into paying for sex with Laude, not knowing that the latter was a man.

''Pemberton could have been so excited and sexually aroused and started reaching for a vagina, hoping to consummate the act. When he felt something weird, he realized what was on top of him was a man,'' the court said.

"This overcame his reason and self control," the court added.

The court said the second mitigating circumstance afforded to Pemberton was his intoxication defense.

''Pemberton did not have any plan to kill Laude as he and his buddies were only out on liberty. Thus, his drunkenness is not subsequent to kill Laude,'' the court said.

The court also granted weight to the testimony of US Marine Lance Corporal Jairn Michael Rose and Corporal Christopher Miller.

Rose earlier told the court Pemberton admitted: "I think I killed a he or she" on the night of Laude's death.

Miller, meanwhile, said Pemberton told him that he "might have f*cked bad."

''The admissions by the accused to Corporal Rose and Miller are considered admissible as evidence against the accused,'' the court said.

Laude's body was discovered inside the bathroom of Celzone Hotel in Barangay West Tapinac, Olongapo City in October last year.

Hotel staff found the lifeless Laude wrapped in a bed sheet, with her head slumped in the toilet bowl.

Police said Laude checked in at the hotel with a foreigner, who appeared to be in his mid-20s. The foreigner then left the room after about half an hour.

Initial investigation revealed Laude's neck was pressed down on the toilet seat, while her head was being shoved into the toilet bowl.

Police then tagged a US Marine as the person who accompanied Laude in the motel. This US personnel would later be identified as Pemberton.

On December 15, 2014, prosecutors found basis to file murder charges against Pemberton for the death of Laude, and ordered the latter to face trial for murder in a Philippine court. He was ordered arrested a day later and had since stayed in a US-controlled detention facility in Camp Aguinaldo.

In what was considered a breakthrough in the case, Pemberton himself admitted that hechoked and hit Laude during his trial.

In his direct testimony in court, Pemberton alleged this was done in defense of his honor and life after he there was an exchange of blows between them when he found out that a fellow male gave him oral sex.

However, the court dismissed Pemberton's self-defense argument, noting that there was no unlawful aggression on the part of Laude.

''Unlawful aggression is wanting under the circumstances. Attack coming from Laude did not put in peril life of Pemberton,'' the court said.

Pemberton's lawyers' basis for saying that the US Marine should be acquitted was the prosecution's supposed failure to explain why Laude's neck bore traces of three kinds of DNA, including those of the victim and the suspect.

Defense lawyers' had theorized that another person might have killed Laude, said by forensic experts to have died on Oct. 12. Pemberton left the hotel at 11:30 p.m. the previous day.

However, the court said the defense failed to establish how the other people who had knowledge of Pemberton and Laude's presence in the motel could have perpetrated the killing.

It said there is also the possibility that the DNA of the third person could come from any of the investigators and rescuers.

''All of the above circumstances sufficiently established were taken together by the court as they formed an unbroken chain that led to the reasonable conclusion that Pemberton, to the exclusion of all others, is responsible for killing of Laude,'' the court said.

The court added that while defense witnesses managed to establish Pemberton's good character, ''if the evidence of the crime is clear and convincing, evidence of good character will not prevail.''

The death of Laude triggered calls for the abolition of the Visiting Forces Agreement, which allows US forces to have a rotational presence in the Philippines.



Prosecution lawyers Harry Roque and Virgie Suarez lamented that the US Marine should have been convicted for murder instead.

"This is not of course a complete justice, but we have to recognize that there is victory here," said Suarez.

Roque questioned why the court ruled that there was no evidence of cruelty in the slay of Laude when she was supposedly clearly brutally killed.

The mother and sisters of Laude, likewise, expressed the same sentiments.

"Nagpapasalamat ako sa lahat. Nasiyahan naman ako dun sa pagbasa dahil inisa-isa, hinimay-himay talaga lahat... Pero hindi ako kuntento dun sa sinabi na anim na hanggang sampung (sic) taon. Bakit ganun?" said Laude's mother, Julita.

"Ang importante makukulong siya. Hindi nasayang yung pinaglalaban namin. Makukulong siya. Hindi nasayang ang buhay ng anak ko na hindi niya mapagbabayaran," added Julita in tears.

LOOK: What Kris, sons are wearing to PNoy's last SONA


MANILA – “Wear Pinoy” and “love local” – these are the fashion pegs of TV host and actress Kris Aquino as she attends the last State of the Nation Address (SONA) of her brother, President Benigno Aquino III, on Monday afternoon.

Aquino and her two sons, Josh and Bimby, had their usual photo at the living room of their home shortly before heading to the Batasang Pambansa in Quezon City, where the SONA is annually held.

Aquino is seen wearing a blue Filipiniana gown by young designer Michael Leyva. The dress uses fabric from Lumban, Laguna.

Josh and Bimby, meanwhile, are shown in matching embroidered piña Barongs using fabric from Lucban, Quezon.



“My brooch holding the panuelo in place was my mom’s,” Aquino wrote, referring to her late mother, President Corazon Aquino.

Aquino was styled by Boop and Kimi Yap, while her sons were styled by Bang Pineda and Gian Carlo David. Makeup and hair, meanwhile, were by Juan Sarte and Nante Alingasa, respectively.

LOOK: Dingdong, Marian spend honeymoon in Boracay


MANILA – Newlyweds Dingdong Dantes and Marian Rivera spent their first few days as a married couple in the paradise island of Boracay.

The couple of over five years tied the knot in a ceremony widely publicized as a "royal wedding" last December 30 at the Immaculate Concepcion Cathedral in Quezon City.

In her personal Instagram account, Rivera shared her photo with Dantes and her father sitting by the grotto on the famous white sand beach.

In the caption, the actress said, unedited: “Thank you Lord for everything... #Gratitude




Television host Tim Yap also posted a picture of the two celebrities as they watch the setting sun.

“The sun shines on them: Boracay sunset sesh with lovebirds @dongdantes @therealmarian #DongYanHoneymoon,” Yap said in the caption.



In a previous interview, Rivera had said that she wants to have a baby with Dantes immediately after their wedding.

“Sabi ko nga agad agad [kami magkaroon ng baby]. Pagka ‘I do’ 'yun 'na yon. Sana bigyan kami ng Panginoon na magkaanak talaga dahil ang anak ay blessing talaga. Hindi pwedeng gusto mo, mangyayari na sa 'yo. Kusang ibinibigay sa iyo 'yan ng Panginoon,” she said.

STI partners with BPO provider


MANILA, Philippines - STI Education Services Group has partnered with a leading business process outsourcing (BPO) provider to train its students for careers in outsourcing.

In a disclosure to the stock exchange, STI said it recently signed a partnership agreement with SITEL, one of the world's leading BPO provider of customer care and outsourcing services.

Under the agreement, STI students will receive training from SITEL for the skills and qualifications needed for outsourcing careers.

Aside from training sessions, SITEL will provide content for STI courseware and curriculum. Students can also opt to undergo their internship at SITEL.

STI said their faculty members will also undergo training from SITEL.

SITEL, on the other hand, will post job opportunities for graduating STI students.

"The partnership provides intensive preparations with mock interviews using SITEL's Language Assessment tool in which our students' communication skills will be gauged, Employment seminar to gear them towards better prospects for job application, and language training for our Communication Arts subjects. Our graduating students from all programs will benefit from these learning activities, which is also why we are working with SITEL to give our students a heaed start with our Manila campuses andthen expanding to the rest of our schools nationwide," STI vice president for academics Dr. Lloyd C. Bautista said.

For SITEL's part, Haidee Enriquez, vice president for global recruitment, said: "Together, STI and SITEL will find ways by which we can help bridge the gap between the quality of STI's graduates and the minimum competencies that we require our employees to have."

Meet the Pinay who started the 'tapsilog' craze

MANILA, Philippines – Ever wondered who started the “tapsilog” craze in the Philippines?

Restaurant owner Vivian del Rosario of Tapsi ni Vivian claims she was the first to coin “tapsilog” or tapa, sinangag (garlic fried rice), and itlog (fried egg).




“Noong araw nag-umpisa lang ako sa tinda namin lugaw-lugaw lang, tapos nagtinda din ako ng tapa at mga sinangag. Naisipan ko mag-imbento ng pangalan, ‘yun nga ang sinasabi nilang tapa, sinangag at itlog. Shinortcut ko ng ‘tapsilog.’ Ako ang kauna-unahang nag-imbento ng tapa, sinangag at itlog,” she said on “My Puhunan.”  





Del Rosario popularized the Filipino favorite when she opened the first branch of Tapsi ni Vivian at Lauan Street corner Molave in Project 3, Quezon City in the 1980s.

But before her success, del Rosario said she also went through the hardships of being an entrepreneur with a limited budget.

“Mahirap talaga dahil nagsimula ka sa maliit, dapat magsikap ka. Pagsikapan mo at magsipag ka, gumising ka ng maaga, magluto ka,” she said.

Del Rosario’s first stab at the food industry came in the form of a small cafeteria at a parking lot.

Her patrons then were mostly jeepney drivers looking for cheap meals during their lunch break.

With a capital of P1,000 per day, del Rosario said she made P2,000 from selling rice meals.

“Gigising ako ng madaling araw, mga alas-kwatro, tapos mamamalengke, magluluto, magtitinda sa jeepney driver,” she said.

 





Now at 62 years old, del Rosario still practices the hands-on approach to her food business, which has expanded to more branches in Marikina.

Tapsi ni Vivian now has a full menu of dishes and is offering catering services to seminars, weddings and corporate events.

Del Rosario said aside from her cooking, what made her successful is her down-to-earth attitude that endeared her to her customers.

“Kailangan masarap ang luto, masarap ang pagkain, malinis, at hindi ka masungit sa tao. Hindi ka dapat mayabang at mapagmalaki, kailangan marunong ka lumingon sa pinaggalingan mo,” she said.

BPO firm opens Eastwood facility


MANILA, Philippines - Human resource business process outsourcing (HR BPO) company Talent2 has opened a new 500-seat shared service center in Eastwood in Quezon City to better serve growing demand from  its clients.

In a briefing yesterday, Mary Sue Rogers, Talent2 global managing director said the new facility is the firm’s biggest in Asia Pacific and will serve as the central hub for its operations in the region.

“We picked the Philippines because of talent, time zone, English-speaking proficiency and its fun people,” she pointed out.

She also said the firm chose the Philippines as it is not only a good location for their operations but an important market as well.

“We don’t only see the Philippines as HR BPO location but also as a sales market where we can grow,” she said.

She noted that demand for HR services from firms with operations here as well as in Indonesia and Malaysia is growing.





The new shared service center, which occupies a seven-story building over a 3,000 square meter area in Eastwood, is seen to support the firm’s expansion and focus on the fast-growing Asia Pacific region.

The ne w facility provides services such as HR advisory, recruitment, payroll and learning to clients from the Philippines, Malaysia, Singapore, Hong Kong and Australia.

Services in the newly-opened facility are currently being carried out by 130 individuals and the firm expects to fill the 500-seat capacity sometime next
