De Lima urged: 'Bring the truth' on INC controversy


MANILA – As members of the Iglesia Ni Cristo staged a demonstration outside the office of the Department of Justice along Padre Faura, Manila, netizens urged Justice Secretary Leila De Lima to continue the investigation into the alleged abductions and illegal detention of ministers of the religious sect.

Iglesia members have accused de Lima of meddling into the Iglesia ni Cristo's affairs and of giving special attention to the criminal charges filed by former INC minister Isaias Samson Jr. against members of the INC Sanggunian.

On Twitter, netizens told De Lima to continue the investigations.

Miriam on Bilibid luxuries: Make prisoners pay


MANILA - If you can't stop them, at least make them pay.

This, according to Senator Miriam Defensor-Santiago, should be the government's response to the luxurious lifestyle of certain inmates at the national penitentiary.

"Several years ago, I recommended that we should follow the procedure in the United States where they are allowed not necessarily luxurious but at least improved circumstances of detention over those who are just treated in a regular manner," she told reporters on Wednesday.

"Then we can make them pay and give the money for government funds."

Calling the situation old news, Santiago said the discovery of some prisoners' luxurious lifestyle has been going on for a long time.

"If you cannot prevent it, then you must mitigate it," she said.

Santiago added that the Justice Department must reveal the identities of officials who have been protecting the system, saying the officials are criminally liable.

The senator does not agree, however, with renewed calls to bring back the death penalty.

On Tuesday, Senator Vicente Sotto III proposed that the death penalty be revived particularly for high-level drug traffickers like the ones who were found to be enjoying luxuries while in jail.

Santiago pointed out that the Philippines has international commitments to abolish death as a punishment for crimes.

"If we are about to make a U-turn here, we have to contend with the opposition of the European countries," she said. "Plus it will not sit well with the coming visit of the Pope of the Catholic Church, which has always been anti-capital punishment."

DOJ: Binay can't dictate what we can investigate



MANILA - The camp of Vice-President Jejomar Binay is not in a position to dictate what the Department of Justice can or cannot investigate, Justice Secretary Leila de Lima said Friday.

Speaking before a gathering of public attorneys in Manila led by the Public Attorney's Office (PAO), De Lima said the more Binay's camp pushes the DOJ and the National Bureau of Investigation (NBI) to halt its probe, the more doubts are raised, and the more the investigation should proceed.

"The issue here is not whether or not the DOJ can investigate the vice-president. The issue is, and will remain, whether or not the accusations of systemic corruption in Makati and the amassing ill-gotten wealth are true," she said.

"If the subject of the investigation asks the DOJ to stop, for one reason or another, the commonsense response is not to grant the request but to do the exact opposite: pursue the investigation even further," she added.


De Lima directed the NBI on Thursday to investigate Binay, his family, his alleged dummies, contractors of Makati City projects, and their alleged cohorts in a scheme of plundering the city's coffers. The accusations were made public by Binay's former ally, ex-Makati Vice-Mayor Ernesto Mercado, and several other individuals.

Binay's camp hit the DOJ for ordering the probe, accusing De Lima of engaging in a "political circus," and threatening her of disbarment.

Binay's spokespersons said the DOJ has no jurisdiction over the issue because the vice-president is an impeachable officer.

De Lima, however, said Binay's camp is not in the position to define nor limit her department's powers to investigate.

"It is not up to him (Binay) or his spokespersons to determine the limits of the department's power to investigate impeachable officers; it is only the Supreme Court that can interpret the department's powers of investigation under the law," she said.

"It is also in the same spirit of performing our mandate under the Administrative Code that we are, therefore, now minded to do our own investigation parallel to that of the [Senate Blue Ribbon Committee] and the Ombudsman."

ANSWER ACCUSATIONS

De Lima challenged Binay's camp to answer the allegations instead of raising "irrelevant" matters and accusing the DOJ of politicking.

She stressed that the public deserves to know the truth and this is what Binay, as a public official, should give them instead of "reckless innuendos."

These innuendos do not prove Binay's innocence nor disprove the claims agains him, she stressed.

Binay, in several media interviews and speaking engagements, accused administration allies of conspiring to douse his 2016 presidential bid; he also hit the administration of not dealing with the country's "real problems."

"Rather than question the department's (DOJ's) jurisdiction and priorities, the vice-president should instead directly confront the allegations on the systemic corruption of Makati's procurement system. Rather than question the legal basis for the [Disbursement Acceleration Program], he should confront accusations of amassing ill-gotten wealth," De Lima said.

"To say that the DAP was used by [Budget Secretary Butch Abad] to bribe senators is not a valid defense against the accusations of corruption in Makati. To claim that President [Gloria] Arroyo is innocent and merely being persecuted by this administration despite her illness is not a convincing response to testimonial evidence of unprecedented plunder of local government coffers. To say that he once fed his vice-mayor [Ernesto Mercado] from his own hands only for Mercado to turn against him and that he (Mercado) has 'no utang na loob' is definitely not the best way to impeach a witness."

"To question why I did not release the supposed 5-hour video of Janet Lim Napoles -- and I'm not admitting to the existence of that video 'spilling the beans on administration allies' -- it will never rebut the COA (Commission on Audit) findings of overpricing of hospital beds and medical equipment. To expose the alleged luxury vehicles of Sen. [Antonio] Trillanes will never explain the airconditioned piggery and English garden inside a 350-hectare estate."

"They have said everything except the one thing we really, really seek and need: the truth."

As to the criticism that the DOJ should focus on over investigations and cases, De Lima said Binay's camp should not tell the department what to do and how to do its job.

She stressed that the department should not be selective in its investigations, especially those involving allegations of corruption against government officials.

"Let our record speak for us. In the past 4 years, the DOJ has never shied away from investigating and prosecuting the most controversial cases involving the most powerful politicians and officials. The DOJ investigated a former president (Arroyo), 3 sitting senators (Senators Juan Ponce Enrile, Bong Revilla, and Jinggoy Estrada), aside from several congressmen and executive officials and is investigating more. That the case is high profile or involves a powerful politician was never a reason for the DOJ to inhibit from conducting a probe."

"Definitely, it's not a reason for the DOJ to refrain from investigating now. This case is no different. Why would the DOJ now shy away from another investigation of another case of alleged corruption and plunder? If the DOJ does refrain from investigating now, would it not constitute a case of special treatment or dereliction of duty?" De Lima said.

If Binay has nothing to hide, he should welcome the investigation, considering that he has already expressed lack of faith in the ongoing Senate inquiry into the alleged overpricing of Makati City projects and his alleged unexplained wealth, she added.

De Lima also stressed that Binay's camp cannot invoke his so-called immunity from suit in criticizing her move to call for the probe since the NBI investigation will cover not only the vice-president but all those allegedly involved in the "unprecedented corruption allegations" in Makati, all of whom cannot claim any immunity from criminal proceedings.

MANILA - Senate Blue Ribbon Committee Chairman Teofisto 'TG' Guingona III made public on Thursday the signed Janet Napoles list of alleged pork barrel scam players after it was submitted by Justice Secretary Leila de Lima.

De Lima had asked for one more week, or until May 22, within which to submit both the list and Napoles' affidavits.

Guingona allowed the extension for the affidavits, but not the list.

“I did not allow the extension [for the list]. It’s time we put an end to the speculation," he said. He noted there are so many lists going around that have spawned a lot of speculations.

The Napoles list is the same as that submitted by Senator Panfilo Lacson.

However, there are other names, handwritten by Napoles, that have been added to the list.

In her letter to Guingona, De Lima said the Napoles camp has yet to finish an extensive affidavit that would support the list that merely contains the names of those allegedly involved in the corruption scheme.

“[I] respectfully recommend that the committee, instead of disclosing the list and the still unverified allegations to the public, could perhaps consider either awaiting the completion of the vetting process or fact-finding investigation by the DOJ/NBI… or refer the documents to the Ombudsman or the Inter-Agency Anti-Graft Coordinating Council,” De Lima pleaded.

Guingona told ANC that while the affidavits are paramount in giving credence to the list, “I believe the signed list should already come out, because it will come out anyway. There’s no reason to delay anymore."

He also noted the list should be corroborated and cross-referenced with the testimonies of the pork barrel scam whistleblowers.

“Cross-referencing and corroborating are important aspects of finding the truth, but what’s also important is we have a transparent process."

As a necessary consequence, Napoles will have to be called back to the Senate and thresh out her story.

“The next rational step is to ask the author to come forward," he said.

Napoles is still at the Ospital ng Makati even though authorities have already given her the green light to leave. She has yet to pay her bills.

Meanwhile, Guingona said he can’t say if the other lists can now be discarded in favor of the signed one.

“Let me hold judgment on that. Based on face value, this [signed list] should be given weight.”

Group eyes SC help to open Napoles list


MANILA – A whistleblowers group on Friday said it will ask the Supreme Court (SC) to order Justice Secretary Leila de Lima to finally release the copy of Janet Lim Napoles' list of people supposedly involved in the pork barrel scam.

Whistleblowers Association of the Philippines President Sandra Cam said her group will file a petition for mandamus before the SC next week to order de Lima to make the list public.

The supposed list is contained in the sworn statement that Napoles earlier submitted to de Lima following her decision to ''tell all'' that she knows about the scam.

"Ako ay nagcha-challenge sa kanya ng face off para makita kung sino sa amin ang nagsisinungaling pagdating diyan sa mga dokumento na dapat niyang ilutang sa publiko dahil binabayaran siya ni Juan dela Cruz,'' Cam told dzMM.

"Sobra na itong ginagawa ng secretary of Justice... Lalabas kami kahit sa tingin niya ay maliliit na tao lang kami... Lalaban kami sa posisyon na ito dahil nakakaawa na ang taumbayan."

In an earlier newspaper report, Cam claimed to have been given a copy of the list, in which several names of lawmakers who were previously not implicated in the scam appeared.

Cam said she would like to check if the list in de Lima's hands has been sanitized of Aquino allies.

De Lima belittled Cam's claim, saying the latter had no authority and standing on the issue.

The justice chief had said she will ask Napoles' camp if, indeed, it gave out lists to other people, saying she is not aware of it.

She added she would not to bow down to pressure stemming from reports about Napoles' list being released by various quarters.

She believes this is part of the reason why "lists" are coming out, precisely to pressure her into releasing the names Napoles gave her.

Tuason as state witness a tactical decision: De Lima


MANILA - Justice Secretary Leila de Lima defended the admission of "pork barrel" scam respondent-turned-state-witness-applicant Ruby Tuason into the Department of Justice's (DOJ) Witness Protection Program (WPP) on provisional coverage.

The justice chief stressed that the DOJ's move was a "tactical decision."

De Lima said that Tuason's testimony has a value added to the evidence of the DOJ and NBI against those charged for the multi-billion peso scam; and it completes the entire picture since Tuason has "direct personal knowledge" about the delivery and receipt of the supposed kickbacks.

Every time the DOJ admits anybody to turn state witness, it is always in furtherance of successful prosecution, she pointed out.

De Lima: Tuason's testimony clearly shows she's credible


MANILA - Ruby Tuason's failure to "recall" details about her alleged Priority Development Assistance Fund (PDAF) transactions with Sen. Jinggoy Estrada and the camp of Sen. Juan Ponce Enrile should all the more convince the public that that she is a credible witness, according to Justice Secretary Leila De Lima.

De Lima issued the statement amid Sen. Antonio Trillanes' dismay at Tuason's testimony before the Senate Blue Ribbon Committee on Thursday.

The justice chief said Tuason's answers to the queries of senators clearly showed she was not forcing herself to come up with a story after having forgotten the details of her encounters with the camp of the two lawmakers charged for siphoning portions of their "pork barrel" to bogus non-government organizations (NGOs) put up by alleged "pork barrel" scam architect Janet Lim Napoles.

"I don't blame Senator Trillanes and I respect his reservations about the testimony of Mrs. Tuason. May mga punto naman talaga si Sen. Trillanes. Ang take ko dyan, you must understand, si Mrs. Tuason she admits na sya ang go-between, the agent, yung middle man, sya yung taga abot.

"Yun lang role niya eh, tagahatid ng kickback, nung share ng lawmakers involved so siyempre, ang interst lang niya siguro is just her share, yung referral fee so she didn't deem it proper or desirable na she would keep track or she would also record yung mga hinahatid nyang kickback. Yun kasi, para sa kanya nga, trabaho yun nina Janet Lim Napoles, yung mga staff nya, especially Benhur Luy kaya ganun hindi nya masabi yung detalye o hindi nya maalala yung exact amounts, yung exact dates. Yung year lang naaalala nya, 2008."

De Lima said Tuason's testimony is important in the plunder case against Estrada and Enrile because she has "direct knowledge" of the giving of kickbacks to the two senators because she "personally delivered" the kickbacks.

"So what I'm trying to say is that it's actually plausible na it's what makes her more credible, na hindi nya pinipilit mag-provide ng detalye na hindi naman nya kayang iprovide, di ba? Kasi nga hindi nya trabaho ung magbilang nung mga kickbacks na yan, hindi nya trabaho ung magrecord ng mga yan.

"Para sa kanya, tagahatid lang siya....at every time na naghahatid sya, meron din dyang komisyon so siguro yung binibilang niya yung sarili lang niyang komisyon."

De Lima said Tuason's testimony corroborated the testimony of Benhur Luy and the other whistleblowers regarding the scam.

The justice chief also pointed out that Tuason's answers before the Senate hearing only showed she is not being coached by the Department of Justice (DOJ) nor the National Bureau of Investigation (NBI) on what she has to say.

Probes into rice smuggling are 'coordinated,' says De Lima


MANILA - They may be holding separate and simultaneous investigations into the rice smuggling trade in the country, but the National Bureau of Investigation (NBI), Department of Agriculture (DA), and Bureau of Customs (BOC) are coordinating their efforts and sharing data, according to Justice Secretary Leila de Lima.

Fresh from the third Senate inquiry hearing into rice smuggling by the Committee on Agriculture and Food on Wednesday, De Lima said the "coordinated parallel" investigations are aimed at achieving the best results: identifying the personalities behind the illegal trade, prosecuting them before the courts, and coming up with policies to stamp out rice smuggling.

De Lima ordered the NBI, an attached agency of the Department of Justice (DOJ), to investigate rice smuggling in various ports in the country as an offshoot of the Senate Agriculture Committee's findings and recommendations in 2013.

"Kahit wala naman kami, strictly speaking, a joint probe or official probe na ginagawa ngayon, you can say we are having a coordinated parallel probe na ginagawa ngayon. Nag-iimbestiga kami, nag-iimbestiga rin sila, pero mayroonn na kaming coordinated probe.

"What exactly is coordinated parrallel probe? Nagsi-share kami ng information, nag-eexchange kami ng information with each other, nag-aassist. We are extending assistance to each other," De Lima said.

The justice chief admitted that the technical expertise of the DA and BOC will greatly help the NBI in its probe.

"NBI is investigative, pero yung mga technical aspects of the investigation, majority or the dominant facts that may be established, have to come from the data, from the inputs, from the records from the BOC and sa NFA (National Food Authority) kaya nagtutulong tulong kami sa isa't isa.

"Kaysa naman dati na walang coordinated probe; because of the coordinated probe, magkakaroon kami ng results," De Lima said.

DOJ eyes putting Napoles on Interpol red list


MANILA - Justice Secretary Leila de Lima on Thursday said businesswoman Janet Lim Napoles, the alleged mastermind in the P10 billion pork barrel scam, is still in the country. She said the National Bureau of Investigation is working on putting her on Interpol's red list in case she slips out of the country.

De Lima said there is no indication Napoles has left the country, pointing out the difficulty of doing so since Napoles' passport has been cancelled.

She said the NBI is already pursuing several leads in arresting Napoles. However, the agency is cool to the idea of putting a bounty on Napoles since whatever bounty the government may impose maybe peanuts to Napoles' assets.

"No indication nakalabas. Mahihirapan kasi cancelled passport. NBI working on Interpol red list lalo na cancelled na passport. The NBI continues to have debate kung, debate karamihan sa kanila, di na raw kailangan kung P1 million, P2 million (bounty) peanuts lang sa if we think of the resources of the subject of manhunt," she said.

She also pointed out that some of the most wanted fugitives are still on the loose despite 2-million-peso bounties on their heads.

"As a matter of principle, di rin maganda rin mercenary element. Alam natin gaano kataas interest ng publiko so enraged by this. Umaasa rin kami sa tulong ng sambayanan," she said.

De Lima said the NBI is still preparing the cases and collating the documents that will be used in filing the strongest cases related to the pork barrel scam. She said they can only file cases connected to Napoles since she is the focus of the investigation.

Other cases will have to be filed regarding the bigger scam as uncovered by a recent Commission on Audit report.

"Standing instruction ng Pangulo ay kung ano malalakas na kaso na pwede nang i-file, i-file na ASAP. Now as you know, ang ini-imbestigahan ng NBI are the Napoles components or portions of the PDAF and even the malampaya fund scams. Even before lumabas yung COA special audit report, yun talaga tinutukan ng NBI gawa ng disclosures ng whistle-blowers. So yung Napoles portions lang nalaman sa COA report mas malaki ito di iyan sakop ng NBI," she said.

Number of cases being finalized


The NBI is focusing its investigation on the alleged pork barrel scam as well as the alleged misuse of P900 million in Malampaya funds being linked to Napoles. De Lima said fake non-government organizations being linked to Napoles are also under investigation.

"Kung ilang kaso at ilan kakasuhan namin, yan fina-finalize pa namin. Katulad ng Pangulo, hindi pa namin pwede sabihin kung sino-sino kakasuhan namin other than Napoles," she said.

De Lima said an inter-agency, anti-graft coordinating council has been formed to probe the bigger scam uncovered by COA. The lead office in this council is the Ombudsman.

"'Yan ang tumutututok sa mga large scale , large scale corruption cases at nagkaroon na kami ng initial discussions diyan. Nagka-initial meeting with Ombudsman and COA. Yung sa Napoles component of the scam sa PDAF meron na kaming mga na-identify na mga pwedeng kasuhan pero fina-file, dino-double check namin yan kasi gusto namin masiguro na yung documents andiyan and in fact kino-collate na iyan. Nawala lang 3 days (because of the weather) pero kundi sana nawala 3 days halos tapos na pag-collate ng documentary support."

De Lima to NBI: Proceed with manhunt vs Delfin Lee


MANILA - Justice Secretary Leila de Lima has reminded the National Bureau of Investigation (NBI) to proceed with the manhunt for Globe Asiatique's (GA) Delfin Lee and his co-accused in a syndicate estafa case pending with a Pampanga trial court in connection with P6 billion in alleged questionable loans given to GA buyers by the Home Development Mutual Fund (HDMF or Pag-IBIG Fund).

Speaking to reporters at the Department of Justice (DOJ), De Lima said the non-bailable case against Lee; Cristina Sagun, GA documentation chief; Christina Salagan, former GA documentation dept. head; Atty. Alex Alvarez, Pag-IBIG employee; and Lee's son, Dexter is very much alive.

De Lima cited a recent Supreme Court (SC) temporary restraining order (TRO) on a Court of Appeals (CA) ruling junking the case against Sagun which would have made the number of accused merely 4, or one person short of the minimum requirement of 5 for a syndicated estafa case to prosper.

"I reminded the NBI to proceed with the manhunt for Lee and his co-accused. Wala pa sa kanila nagsu-surface or voluntarily submit to the jurisdiction of the Pampanga RTC. The TRO is meant to enjoin the implementation of the CA decision; since restrained ang CA resolution, the case stays...

"Therefore, there is no legal impediment now on the part of the [Regional Trial Court] Pampanga to proceed with the case of syndicated estafa," De Lima said.

Lee is considered a fugitive from justice. Malacanan has announced a reward of P2 million for any information that may lead to his arrest.
